Terms of Use

This Product Purchaser License Agreement ('Agreement') sets forth the terms and conditions of your product or service, and a Disclaimer limiting the intended results of a product or service.This product is licensed, not sold. As a condition of your license purchase of any of these products, you agree to the following terms and conditions of use. Please review them carefully as these terms and conditions of use represent an important legal agreement between you and your purchase of products from What If? The Movie LLC

END USER TERMS AND CONDITIONS OF USE This is an Agreement between you, the end user of any of these products, and What If? The Movie LLC a limited liability company ('What If? The Movie LLC'), regarding the product use. By placing an order for these products you expressly agree to all of the following terms and conditions.

COPYRIGHT AND TRADEMARK INFORMATION These products and associated materials (collectively referred to in this Agreement as 'product') is © copyrighted 2007-2008 by What If? The Movie LLC, all rights reserved. Warning: federal law provides severe civil and criminal penalties for the unauthorized reproduction or public distribution or exhibition of copyrighted video, motion pictures, or video discs. This product is protected by title 17, United States code, including but not limited to, sections 501, 504, and 506, and international copyright treaties, as well as other intellectual property laws and treaties.

What If? The Movie LLC, the names of these products, and the stylized versions of these are all trademarks of What If? The Movie LLC. All title and copyrights in and to the product, including audio, music, text images, photographs, animations, video, are owned by What If? The Movie LLC or its suppliers.

FBI WARNING The Federal Bureau of Investigation actively investigates allegations of criminal copyright infringement under title 17, United States code.

GRANT OF LICENSE This product is licensed for the individual purchaser for both personal viewing and to others as long as it is not in a commercial venue. You agree that any public performance for personal profit, other use, or copying is strictly prohibited. This Agreement permits you to receive a single license for the non-commercial exhibition of this product. What If? The Movie LLC will, in all circumstances, vigorously pursue anyone who infringes upon or otherwise violates its rights under this contract or at law or equity for the maximum remedies, protections, and statutory damages allowable under but not limited to title 17, United States code, chapter 5.

ENTITLEMENT You are licensed to retain this product for viewing as long as it is not used as initiation of financial gain by copying for distribution, its content in whole or in part. 

DISCLAIMER AND RELEASE FROM LIABILITY You understand and agree that the information contained in this product is for your personal entertainment purposes only. Statements made and concepts conveyed throughout these products are personal opinions only. What If? The Movie LLC, and the various authors or contributors make no representation otherwise. You are responsible for your own behavior and conduct. None of the material contained herein is to be considered legal or personal advice, but is strictly information on the experiences of others.

These products are provided 'as is' with all faults and without any warranties of any kind whatsoever (either expressed or implied) including no warranty or condition of title, quiet enjoyment, quiet possession, correspondence to description, or non-infringement with regard to the product, and you alone assume any and all risk associated with use of these products. By purchase and/or use of these products you waive any claim whatsoever against and hold harmless What If? The Movie LLC, and any marketing What If? The Movie LLC officers, staff, advisors, representatives, or designees that may arise from such use. By using the product in any way you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this license Agreement, you are not authorized to use the  product. If you do not agree to this, do not purchase the product. This waiver specifically also includes but is not limited to any claim arising from products and/or service which you purchase from What If? The Movie LLC or any information you receive via postal mail, Email, fax, or otherwise. This includes but is not limited to responsibility for the accuracy or compliance with any applicable local laws. Notwithstanding any damages that you might incur for any reason whatsoever (including, without limitation, all damages referenced above and all direct or general damages), The entire liability of What If? The Movie LLC and any of its suppliers under any provision of this Agreement and your exclusive remedy for all of the foregoing shall be limited to the greater of the amount actually paid by you for the product or U.S. $4.00. If you acquired this product in the United States, this Agreement is governed by the laws of the State of California. Neither What If? The Movie LLC nor any marketing What If? The Movie LLC officers, staff, advisors, representatives, or designees shall be liable in any way whatsoever (including, but not limited to, negligence) for any direct, special or consequential damages resulting from either your use of these products or your inability to use it even under any circumstance in which What If? The Movie LLC or any of its representative(s) have been advised of potential liability, damages, or injury. What If? The Movie LLC or its suppliers shall not be liable in any event for any punitive, special, incidental, consequential or indirect damages whatsoever (including, but not limited to, damages for loss of profits or confidential or other information, for personal injury, for business interruption, loss of privacy, failure to meet any duty including of good faith or of reasonable care, for negligence, and for any other pecuniary or other loss whatsoever) arising out of or in any way related to the use of or inability to use the product. Certain applicable laws may not allow all the limitations of liability described herein. To the extent that any of the above remedies and/or limitations should be deemed to fail of their essential purposes, you agree that What If? The Movie LLC's total liability to you under any circumstances whatsoever, including but not limited to losses, damages, causes of action, and/or negligence, shall not exceed the total price paid for these products.

You acknowledge that the product is subject to U.S. export jurisdiction, and as such agree to comply with all applicable international and national laws that apply to these products, including the U.S. Export Administration Regulations, as well as end-user, end-use and destination restrictions issued by U.S. and other governments.

This Agreement constitutes the entire understanding of the parties, and revokes and supersedes any and all prior agreements between the parties and is intended as a final expression of their agreement. No waiver by either party of any default shall be deemed as a waiver of prior or subsequent default of the same of other provisions of this Agreement. This Agreement shall take precedence over any other documents that may be in conflict therewith.

This policy and the use of this Site are governed and interpreted pursuant to the laws of the province of Alberta. Viewers of and visitors to this website agree that any applicable law is in all cases that of the province of the site owner. If any part of these Terms of Use is unlawful, void or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining terms. This Agreement constitutes the entire agreement among the parties relating to this subject matter. Notwithstanding the foregoing, any additional terms and conditions on this site will govern the items to which they pertain. 

If a dispute arises and it proves impossible to arrive at a mutually satisfactory solution, we agree to submit the dispute to binding arbitration at the following location: Calgary, Alberta, under the rules of the Alberta Arbitration & Mediation Society. We agree to first try to resolve it with the help of a mutually agreed upon mediator in the following location: Calgary, Alberta. User is solely responsible for any costs and fees, including attorney fees and experts' fees associated with the mediation. In no case shall the viewer, visitor, member, subscriber or customer have the right to go to court or have a jury trial. By use of this website or purchasing a product through this website, you waive the right to use state, provincial or federal court systems to address complaints and, instead, agree to use the Alberta Arbitration & Mediation Society located in Calgary, Alberta, Canada. Viewer, visitor, member, subscriber or customer will not have the right to engage in pretrial discovery except as provided in the rules; you will not have the right to participate as a representative or member of any class of claimants pertaining to any claim subject to arbitration; the arbitrator's decision will be final and binding with limited rights of appeal. 

This statement and the policies outlined herein are not intended to and do not create any contractual or other legal rights in or on behalf of any party. In the event that litigation is in a federal court, the proper court shall be the closest Canadian federal court to the address of What If? The Movie LLC.

DVD RETURN POLICY 
We will replace any defective product that is returned within thirty (30) days of receipt. Additionally, we will provide a refund less shipping and handling as well as a re-stocking fee during the first thirty (30) days of receipt for unopened merchandise.  To return an item please contact:  whatifthemovieorders@gmail.com

What If? The Movie Digital Viewing

-Terms of Use-

THIS IS AN AGREEMENT BETWEEN YOU AND What If? The Movie, LLC  PLEASE READ THESE TERMS OF USE, ALL RULES AND POLICIES RELATED TO THE What If? The Movie Digital Viewing SERVICE.  By using the What If? The Movie Digital Viewing SERVICE YOU WILL BE BOUND BY EACH OF THE TERMS OF THE AGREEMENT.

1. THE SERVICE

What If? The Movie Digital Viewing SERVICE (the "Service") offers a digitized version of What If? The Movie (collectively, "Digital Content") and other services under certain terms and conditions as set forth in this Agreement. The Service allows you to access and view Digital Content in two different ways: by streaming a copy, or by downloading a copy.

2. COMPATIBLE DEVICES

In order to be able to stream or download Digital Content from the Service and to view Digital Content on the Service, you will need to use a personal computer, portable media player, or other device that meets the system and compatibility requirements that we establish from time to time and is otherwise capable of interacting with the Service (each such device, a "Compatible Device"). Some Compatible Devices may be used only to stream Digital Content, some Compatible Devices may be used only to download Digital Content, and some Compatible Devices may be used to stream and download Digital Content. We may change the requirements for Compatible Devices from time to time and, in some cases, whether a device is (or remains) a Compatible Device may depend on software or systems provided or maintained by the device manufacturer or other third parties. As a result, devices that are Compatible Devices at one time may cease to be Compatible Devices in the future.

3. DIGITAL CONTENT

a. General.  The Service may allow you to: (i) rent Digital Content for viewing over a limited period of time ("Rental Digital Content"), (ii) purchase Digital Content for viewing over an indefinite period of time ("Purchased Digital The basis on which Digital Content is available on the Service will be indicated on the product detail page for that Digital Content on the Service. From time to time, we may add or remove Digital Content from the Service and may change the basis on which Digital Content is available on the Service.

b. Usage Rules. Your use of Digital Content is subject to the What If? The Movie Digital Usage Rules (the "Usage Rules"). The Usage Rules provide important information regarding your use of Digital Content, including the time period during which you are authorized to view different types of Digital Content (the "Viewing Period" for that Digital Content) and limitations on the number and type of Compatible Devices on which each type of Digital Content may be downloaded, streamed, and viewed.

c. License to Digital Content. Subject to your payment of any applicable fees (including applicable taxes) to rent, purchase, or otherwise obtain access to Digital Content, and your compliance with all other terms we specify for Digital Content or the Service, What If? The Movie, LLC grants you a non-exclusive, non-transferable, non-sublicensable, limited right and license, during the applicable Viewing Period, to access, view, use and display the Digital Content in accordance with the Usage Rules, for Non-Commercial, Private Use. As used herein, "Non-Commercial, Private Use" means a presentation of Digital Content for which no fee or consideration of any kind (other than that which you pay to us to view the Digital Content) is charged or received, which takes place in your private home or apartment or, if outside your private home or apartment (e.g., in a hotel room, dorm room, office, or airport waiting lounge) is limited to a private viewing for you and your invitees. Non-Commercial, Private Use specifically excludes any public presentation (e.g., a presentation in a dorm lounge) and any presentation by a place of public accommodation or other commercial establishment (e.g., a bar or restaurant), even if no fee is charged for viewing the Digital Content. To simplify your viewing and management of Digital Content that has a limited Viewing Period (such as Rental Digital Content and Subscription Digital Content), we may automatically remove that Digital Content from your Compatible Device after the end of its Viewing Period, and you consent to such automatic removal.

e. Availability of Purchased Digital Content. Purchased Digital Content will generally continue to be available to you for download or streaming from the Service, as applicable, but may become unavailable due to potential content provider licensing restrictions and for other reasons, and What If? The Movie, LLC will not be liable to you if Purchased Digital Content becomes unavailable for further download or streaming. You may download and store your own copy of Purchased Digital Content on a Compatible Device authorized for such download so that you can view that Purchased Digital Content if it becomes unavailable for further download or streaming from the Service.

f. Downloading and Risk of Loss. If you plan to download Digital Content that you purchase or rent, we encourage you to do so promptly after your purchase or rental. If you are unable to complete a download after having reviewed our online help resources, please contact What If? The Movie customer service. Once you purchase or rent Digital Content and we make the Digital Content available to you, you are responsible for completing the download, if you choose to download, and for all risk of loss of the Digital Content after download.

g. Streaming. When you stream Digital Content, the resolution and quality of the Digital Content you receive will depend on a number of factors, including the type of Compatible Device on which you are streaming the Digital Content and your bandwidth, which may go up and down over the course of your viewing. If we detect that Digital Content we are streaming to you may be interrupted or may otherwise not play properly due to bandwidth constraints or other factors, we may decrease the resolution and file size of the Digital Content we stream to you in an effort to provide an uninterrupted viewing experience. While we strive to provide you a high quality viewing experience, we make no guarantee as to the resolution or quality of the Digital Content you will receive when streaming, even if you have paid extra for access to high definition content.

h. General Restrictions. You may not transfer, copy or display the Digital Content, except as permitted in this Agreement. In addition, you may not:
i. sell, rent, lease, distribute, broadcast, sublicense or otherwise assign any right to the Digital Content to any third party;
ii. remove any proprietary notices or labels on the Digital Content;
iii. attempt to disable, bypass, modify, defeat, or otherwise circumvent any digital rights management system used as part of the Service; or,
iv. use the Service or Digital Content for any commercial or illegal purpose.


4. SOFTWARE

a. General. We may make available to you, from time to time, software for your use in connection with the Service (any and all such software, individually and collectively, the "Software").
b. Use of the Software. You may use the Software only in connection with the Service. You may not separate any individual component of the Software for use other than in connection with the Service, may not incorporate any portion of it into your own programs or compile any portion of it in combination with your own programs, may not transfer it for use with another service, or use it, or any portion of it, over a network and may not sell, rent, lease, lend, loan, distribute or sub-license the Software or otherwise assign any rights to the Software in whole or in part. We may discontinue some or all of any Software we provide, and we may terminate your right to use any Software at any time and in such event may modify it to make it inoperable.
c. No Reverse Engineering, Decompilation, or Disassembly. You may not, and you will not encourage, assist or authorize any other person to, modify, reverse engineer, decompile or disassemble, or otherwise tamper with, the Software, whether in whole or in part, or create any derivative works from or of the Software.
 
d. Export Regulations; Government End Users. You agree to comply with all export and re-export restrictions and regulations of the Department of Commerce and other United States agencies and authorities that may apply to the Software. If you are a U.S. Government end user, we are licensing the Software to you as a "Commercial Item" as that term is defined in the U.S. Code of Federal Regulations (see 48 C.F.R. § 2.101), and the rights we grant you to the Software are the same as the rights we grant to all others under the Terms of Use.


5. RESERVATION OF RIGHTS.

Except for the rights explicitly granted to you in this Agreement, all right, title and interest in the Service, Software, and Digital Content are reserved and retained by What If? The Movie, LLC and its licensors, and What If? The Move, LLC and its licensors do not transfer any right, title or interest in the Service, Software, or Digital Content. You do not acquire any ownership rights in the Digital Content as a result of streaming or downloading Digital Content.

6. ALL RENTALS AND SALES FINAL.

All purchases and rentals of Digital Content are final. We do not accept returns of Digital Content.

7. ADDITIONAL TERMS

a. Termination. If you violate any of the terms or conditions of this Agreement, your rights under this Agreement will automatically terminate without notice from us, and What If? The Movi may, in its discretion, immediately revoke your access to the Service without notice to you and without refund of any fees. In such event, you must delete all copies of Digital Content that you have downloaded, and What If? The Movie shall have the right, without notice to you, to automatically discontinue your access to Digital Content from the Service.
b. Explicit Content. You understand that by using the Service, you may encounter content that may be deemed offensive, indecent or objectionable, which content may or may not be identified as having explicit language or other features. Nevertheless, you agree to use the Service at your sole risk, and What If? The Movie, LLC shall have no liability to you for content that may be found to be offensive, indecent or objectionable. Content types (including genres, sub-genres, and categories and sub-categories and the like) and descriptions are provided for convenience, and you acknowledge and agree that What If? The Movie, LLC does not guarantee their accuracy.
c. Modification of Service. What If? The Movie, LLC reserves the right to modify, suspend, or discontinue the Service, or any part thereof, at any time and without notice to you, and What If? The Movie, LLC will not be liable to you should it exercise such rights, even if your use of Digital Content is impacted by the change.
d. Amendments. What If? The Movie, LLC reserves the right to make changes to this Agreement at any time. Your continued use of the Service following any such changes will constitute your acceptance of such changes.
e. Third-Party Beneficiaries. Content providers providing Digital Content that you rent, purchase, or view on the Service are intended third-party beneficiaries under this Agreement.
f. Damages Cap.


(i) in no event shall our or our software licensors' total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) arising out of or related to your use or inability to use the Software exceed the amount of fifty dollars ($50.00); and (ii) in no event shall our or our Digital Content providers' total liability to you for all damages arising from your use of the Service, the Digital Content, or information, materials or products included on or otherwise made available to you through the Service, exceed the amount you paid to us to purchase, rent, or view the Digital Content related to your claim for damages.  These limitations will apply to you even if the remedies fail of their essential purpose.

What If? The Movie Digital Usage Rules As described in the What If? The Movie Digital Viewing Terms of Use (above, due to restrictions placed on us by our content suppliers, the videos we make available to you on are subject to restrictions on the ways we make them available to you for viewing (for example, through online streaming or through download) and the duration of time we make them available to you.  The specific restrictions applicable to each of your videos will depend on whether you purchase the video, rent the video, or access the video as a Prime instant video.  These restrictions may change over time as we add new features and content to our service.  Here are the current restrictions:
Purchased Videos


  • Ways to Watch: When you purchase a video, we'll make it available to you to stream and to download as follows:
    • Streaming: You may stream the movie online through your Web browser and through Internet-connected TVs,  You may not stream the same video to more than one device at a time and may not stream more than two videos total at the same time
    • Downloading: You may download videos you purchase to compatible download devices, such as PCs, and may also transfer your purchased videos from your PC to two compatible portable devices, for availability on up to four total devices.  Please not that What If? The Movie, LLC does not make any guarantees that content will work on any portable device or any other device than a PC at this time. 
  • Viewing Period: Indefinite for Digital Downloads-- you can watch and re-watch your purchased videos as often as you want and as long as you want (subject to the limitations described in the What If? The Movie Digital Viewing Terms of Use.  For streaming the viewing period is 24 hours.
